Meet the world's fastest-growing fitness chain - Fortune Management

FORTUNE -- Step inside an Anytime Fitness gym and you'll likely notice more of what it lacks than what is there. No massive machinery, mobs of people, or grunting bodybuilders trying to outdo one another.

You'll also take note of the club's particularly small size -- only 4,000-6,000 square feet, nearly eight times smaller than full-service gyms like Equinox. It's clean and tidy, and there are no employees shoving papers in your face convincing you to sign up for the gym's new weight loss plan, "how to lose 50 pounds in five days."

There is none of that in this decidedly unintimidating environment, and that's exactly how Anytime Fitness CEO Chuck Runyon wants it. "We are Cheers?without the beers."

Cheers, of course, the place where everybody knows your name. But this spot doesn't have any Sam-and-Diane-relationship-tensions, and Norm or Cliff won't be dropping by anytime soon.

It's that vibe that has helped make Anytime Fitness the fastest growing fitness club in the world, according to a report released this year by The International Health Racquet and Sportsclub Association, a title the company has held for the last six years. In 11 years, the Minneapolis-based chain has expanded to more than 2,200 clubs worldwide, in all 50 U.S. states and 14 countries. By comparison, it took Subway 23 years to reach 2,000 restaurants and McDonald's (MCD) 32 years to reach 2,000 restaurants.

Anytime lacks some of the traditional trappings of a gym, but it does have plenty of classes. Walk in, and you will find a kiosk holding more than 100 different video classes that are accessible at all times. Want muscle conditioning? Got it. Want to take a turbo kicking class? They have that too. You pick your class, head into a multi-purpose room, and you're off and running. If the classes don't intrigue you, Anytime Fitness has cardio equipment like treadmills and ellipticals along with resistance workout equipment and free weights.

The relationship between the gym and its members is special, as evidenced by the Anytime Fitness tattoos sported by its passionate members and employees. "It started with a St. Paul franchise owner at a conference in 2005. Since then, over 1,000 people have gotten the Anytime Fitness purple running man tattoo," Runyon said.

He should know. Anytime Fitness foots the bill for the body art; all the tattoo recipients have to do is share why they're getting it. The reasons vary, including some crediting the chain with dramatic weight loss or boosting their self-esteem.

To be sure, Anytime Fitness' ascendance coincides with a boom in the fitness club industry as a whole, with membership expected to reach an all-time high of 52 million in 2013, according to research from IBISWorld. Revenues for gym, health, and fitness clubs in 2013 are estimated to reach a record high of $25.9 billion. Anytime Fitness has seen revenues grow by 80% in the last five years to more than $484 million at the end of 2012, and Runyon anticipates system-wide revenue exceeding $600 million at the end of this year.

So what has fueled Anytime's impressive growth? Pete Moore, founder and managing director of consulting firm and market research firm Integrity Square, thinks it's not just the relaxed atmosphere, pointing instead to its monthly membership costs and 24/7 operating hours model. "Anytime came in charging an inexpensive $35-$55 a month and stripped down labor costs by having the gyms staffed for a certain number of hours, but allowing members to come and go when they like."

Future issues for Anytime Fitness are the same that have plagued the fitness industry as a whole: stagnation and diversification. The industry's memberships and revenue have flat-lined since 2011, and while growth is expected within the next few years, it will be at a slower rate than before. This, along with the growth of competition from yoga studios, Zumba classes, and the convenience of home workouts threatens the future of bigger gyms.

Yet Runyon doesn't feel threatened; he seems to relish the challenge.

"Blockbuster got beat by a better business model in Redbox and Netflix, so we must be prepared to see what's around the corner ... Our focus going forward will be on outside club activities than inside activities," he said.

To extend their reach, Anytime Fitness has created an online health guide, anytimehealth.com, focusing on meal planning, tracking workouts, and sharing members' fitness successes with others. The website also calculates how many calories and pounds members have lost using its nutritional programs.

To be sure, Anytime Fitness isn't abandoning its brick-and-mortar foundation; the company recently acquired Waxing the City, a Denver-based hair removal salon franchise that Runyon says is the kind of "personal improvement brand" he wants to promote with his company.

There are plans for 250 to 300 new clubs over the next four years, and 25-35% of those clubs will be outside the U.S.

If Anytime Fitness continues to grow at that rate, it won't be long before the entire world knows its name.

India's Congress Party agrees to create new state in south

NEW DELHI (Reuters) - India's ruling Congress party approved on Tuesday the creation of a new southern state, a move that has revived deep political divisions and raised fears of violence in the area, home to global firms including Google.

The decision to break up Andhra Pradesh state and establish Telangana comes ahead of elections next year and critics say the ruling party is seeking to shore up its political fortunes after dragging its feet over the explosive issue for four decades.

Supporters, however, say Telangana's economic development has been neglected in favor of the richer and more powerful Andhra region, and that a new state is the only solution.

"It was not an easy decision, we appeal to people to cooperate," said Ajay Maken, a spokesman of the Congress after the party's highest decision-making body adopted a resolution calling for the establishment of a new state, igniting celebrations in parts of Andhra.

Additional federal troops were deployed ahead of the decision in the coastal parts of Andhra Pradesh where people are bitterly opposed to the breakup of the state.

The booming state capital Hyderabad, where Google, Microsoft and Dell have major sites, will remain the common capital for two states for a period of 10 years, Maken said.

Hyderabad, India's sixth largest city, was a bone of contention because it fell in the proposed new state carved out of the western part of Andhra Pradesh.

A government official said there was still a long way to go before the new state, which will have an estimated population of 40 million, became a reality. The measure has to be approved by the Andhra assembly and then the federal parliament where the Congress does not have a clear majority.

"We're swallowing the poison for our party. The decision is very unfortunate but since our leader has taken the decision we'll abide by it. We know the consequences, the problems that will follow," said Rudraraju Padma Raju, the chief whip of the Congress in the state, who has long opposed the split.

"DANGEROUS TREND"

One immediate consequence is likely to be renewed demands from other parts of India for separate states, including in the Darjeeling hills and a further breakup of the most populous Uttar Pradesh state.

Since independence in 1947, successive governments have dealt carefully with demands for new states - creating three in 2000 - while ensuring demands did not spiral enough to threaten the integrity of a nation that now has 1.2 billion people with hundreds of languages, ethnicities and castes.

India currently has 28 states while the United States with a population of 300 million has 50.

The chief minister of revolt-torn Jammu and Kashmir state said he feared the establishment of Telangana would set off more unrest.

"Telangana is a state that will be created on the basis of agitation. It's not created on the basis of any recommendation of a state reorganizing commission or something like that," said Omar Abdullah.

"I believe this is a dangerous trend because all we are doing is sending across a message that if you agitate enough, and if you agitate long enough, you will create a state."

Another fear is that leftist guerrillas who operate in parts of the proposed Telangana state will become further emboldened and take advantage as the new state comes into being.

AP Exclusive: GOP donor's school grade changed

INDIANAPOLIS (AP) ? Former Indiana school Superintendent Tony Bennett built his national star by promising to hold "failing" schools accountable. But when it appeared an Indianapolis charter school run by a prominent Republican donor might receive a poor grade, Bennett's education team frantically overhauled his signature "A-F" school grading system to improve the school's marks.

Emails obtained by The Associated Press show Bennett and his staff scrambled last fall to ensure influential donor Christel DeHaan's school received an "A," despite poor test scores in algebra that initially earned it a "C."

"They need to understand that anything less than an A for Christel House compromises all of our accountability work," Bennett wrote in a Sept. 12 email to then-chief of staff Heather Neal, who is now Gov. Mike Pence's chief lobbyist.

The emails, which also show Bennett discussed with staff the legality of changing just DeHaan's grade, raise unsettling questions about the validity of a grading system that has broad implications. Indiana uses the A-F grades to determine which schools get taken over by the state and whether students seeking state-funded vouchers to attend private school need to first spend a year in public school. They also help determine how much state funding schools receive.

A low grade also can detract from a neighborhood and drive homebuyers elsewhere.

Bennett, who now is reworking Florida's grading system as that state's education commissioner, reviewed the emails Monday morning and denied that DeHaan's school received special treatment. He said discovering that the charter would receive a low grade raised broader concerns with grades for other "combined" schools ? those that included multiple grade levels ? across the state.

"There was not a secret about this," he said. "This wasn't just to give Christel House an A. It was to make sure the system was right to make sure the system was face valid."

However, the emails clearly show Bennett's staff was intensely focused on Christel House, whose founder has given more than $2.8 million to Republicans since 1998, including $130,000 to Bennett and thousands more to state legislative leaders.

Other schools saw their grades change, but the emails show DeHaan's charter was the catalyst for any changes.

Bennett rocketed to prominence with the help of former Indiana Gov. Mitch Daniels, former Florida Gov. Jeb Bush and a national network of Republican leaders and donors, such as DeHaan. Bennett is a co-founder of Bush's Chiefs for Change, a group consisting mostly of Republican state school superintendents pushing school vouchers, teacher merit pay and many other policies enacted by Bennett in Indiana.

Though Indiana had had a school ranking system since 1999, Bennett switched to the A-F system and made it a signature item of his education agenda, raising the stakes for schools statewide.

Bennett consistently cited Christel House as a top-performing school as he secured support for the measure from business groups and lawmakers, including House Speaker Brian Bosma and Senate President Pro Tem David Long.

But trouble loomed when Indiana's then-grading director, Jon Gubera, alerted Bennett on Sept 13 that the Christel House Academy had scored a 2.9, or a "C."

"This will be a HUGE problem for us," Bennett wrote in a Sept. 12, 2012 email to Neal.

Neal fired back a few minutes later, "Oh, crap. We cannot release until this is resolved."

A weeklong behind-the-scenes scramble ensued among Bennett, assistant superintendent Dale Chu, Gubera, Neal and other top staff at the Indiana Department of Education. They examined ways to lift Christel House from a "C'' to an "A," including adjusting the presentation of color charts to make a high "B'' look like an "A'' and changing the grade just for Christel House.

It's not clear from the emails exactly how Gubera changed the grading formula, but they do show DeHaan's grade jumping twice.

"That's like parting the Red Sea to get numbers to move that significantly," said Jeff Butts, superintendent of Wayne Township schools in Indianapolis.

DeHaan, who opened the Christel House Academy charter school in Indianapolis in 2002 and has since opened schools in India, Mexico and South Africa, said in a statement Monday that no one from the school ever made any requests that would affect Christel House's grades.

Current Indiana schools chief Glenda Ritz's office declined comment on the emails.

Ritz, a Democrat, defeated Bennett in November with a grass-roots campaign driven by teachers angered by Bennett's education agenda.

Bennett said Monday he felt no special pressure to deliver an "A'' for DeHaan. Instead, he argued, if he had paid more attention to politics he would have won re-election in Indiana.

Yet Bennett wrote to staff twice in four days, directly inquiring about DeHaan's status. Gubera broke the news after the second note that "terrible" 10th grade algebra results had "dragged down their entire school."

Bennett called the situation "very frustrating and disappointing" in an email that day.

"I am more than a little miffed about this," Bennett wrote. "I hope we come to the meeting today with solutions and not excuses and/or explanations for me to wiggle myself out of the repeated lies I have told over the past six months."

Bennett said Monday that email expressed his frustration at having assured top-performing schools like DeHaan's would be recognized in the grading system, but coming away with a flawed formula that would undo his promises.

When requested a status update Sept. 14, his staff alerted him that the new school grade, a 3.50, was painfully close to an "A." Then-deputy chief of staff Marcie Brown wrote that the state might not be able to "legally" change the cutoff for an "A."

"We can revise the rule," Bennett responded.

Over the next week, his top staff worked arduously to get Christel House its "A." By Sept. 21, Christel House had jumped to a 3.75. Gubera resigned shortly afterward.

He declined comment Monday.

The emails don't detail what Gubera changed in the school formula or how many schools were affected. Indiana education experts consulted for this article said they weren't aware the formula had been changed.

(AP) ? President Barack Obama on Tuesday offered congressional Republicans a new corporate tax cut and jobs spending package he said might "help break through some of the political logjam in Washington," only to have GOP lawmakers immediately throw cold water on the idea.

The announcement and quick rejection underscored how elusive common ground is between the Democratic White House and Republicans in Congress on fiscal issues. The divide was particularly stark on the corporate tax proposal given that both parties generally have supported overhauling the code for businesses, though the White House and Republicans have differed on specifics.

Obama outlined his proposal in a speech at a massive Amazon.com plant in Chattanooga, his latest stop on a summertime campaign to refocus his agenda on the economy. He said "serious people" in both parties should accept his offer.

"I'm willing to work with Republicans on reforming our corporate tax code, as long as we use the money from transitioning to a simpler tax system for a significant investment in creating middle-class jobs," Obama said. "That's the deal."

But the office of House Speaker John Boehner, R-Ohio, complained that Obama's plan was simply a repackaging of proposals the White House has always supported.

"It's the opposite of a concession," said spokesman Brendan Buck, noting that Republicans want to link a corporate tax overhaul with changes in the individual tax code.

In another sign of their sour relationship, Boehner and the White House also dueled over the proposal's rollout, with the speaker's office saying officials there first learned about the plan from media reports. An Obama spokesman said the White House tried to tell Boehner's staff about the plan a day in advance but the call was not returned.

Like Republicans, the president previously has called for corporate tax reform to be coupled with an individual tax overhaul. But his new offer drops that demand and calls only for lowering the corporate rate from 35 percent to 28 percent, with an even lower effective tax rate of 25 percent for manufacturers.

The White House also said the president will continue to seek changes to the individual tax rate as part of a larger "grand bargain" he wants with the GOP. But with the prospects of such a deal growing increasingly slim, Obama advisers say they've opted to isolate an area on taxes where they believe they have more agreement with Republicans.

Obama also wants lawmakers to pour one-time revenue generated from the tax overhaul into jobs programs, including infrastructure, manufacturing and community colleges.

"If we're going to give businesses a better deal, we're going to give workers a better deal too," the president said.

Republicans have opposed using tax revenue to support more spending. Sen. John McCain, R-Ariz., said Tuesday that "everything should be negotiated, but certainly I'm not in support of it."

Administration officials said the jobs programs would be paid for with a one-time revenue boost from measures such as changing depreciation rules or having a one-time fee on earnings held overseas. But they wouldn't put a price tag on the revenue total or the corporate tax overhaul at large.

When Obama first unveiled his corporate tax plan last year, congressional Republicans called for even deeper cuts for the business world. His campaign rival, Mitt Romney, wanted a 25 percent corporate tax rate.

The U.S. has one of the highest corporate tax rates in the world, but many businesses avoid the full cost by taking advantage of deductions, credits and exemptions that Obama wants to eliminate.

Obama wants to do away with corporate tax benefits like oil and natural gas industry subsidies, special breaks for the purchase of private jets and certain corporate tax shelters. He also wants to impose a minimum tax on foreign earnings, a move opposed by multinational corporations and perhaps the most contentious provision in the president's plan.

John Engler, president of the Business Roundtable, welcomed Obama's call for lowering the corporate tax rate. But like many Republican lawmakers, he called for addressing individual tax rates at the same time and said he opposed using corporate tax overhaul revenue for "unrelated spending."

"Corporate tax reform should be part of a comprehensive fix for the individual and business tax codes, and corporate reform should be achieved in a revenue-neutral manner," said Engler, who heads the association of business leaders.

The backdrop for Obama's remarks Tuesday was an Amazon fulfillment center, a massive, 1 million-square-foot warehouse. During a tour of the facility, Obama was shown how the company gets packages ready for delivery, from the employees who pull orders from three stories of floor-to-ceiling shelves, to loading into boxes sealed with water-activated tape and quality control

Amazon announced Monday that it would add 7,000 new jobs, including 5,000 more at U.S. distribution centers that currently employ about 20,000 workers who pack and ship customer orders.

Officials Monitoring Washington, Baxter County Caves For Bat Disease

LITTLE ROCK ? Two caves in northern Arkansas are being monitored following the discovery of a low level of fungus that causes a disease fatal to bats, wildlife officials said Monday.

The fungus that causes white-nose syndrome was discovered in a cave at Devil?s Den State Park in Washington County and a private cave in southern Baxter County, in swab samples taken from hibernating bats in February 2012 and January 2013.

White-nose syndrome is thought to be transmitted primarily from bat to bat or substrate to bat, but fungal spores may be inadvertently carried to caves by humans on clothing and caving gear. The syndrome is not known to pose a threat to humans, pets or livestock.

Bats with WNS may exhibit unusual behavior during cold winter months, including flying outside during the day and clustering near the entrances of caves and mines where they hibernate.

The disease is associated with massive bat mortality in the northeastern and mid-Atlantic United States. Although exact numbers are difficult to determine, biologists estimate that losses may exceed 5 million bats since 2007.

No bat deaths due to white-nose syndrome are known to have occurred in Arkansas, officials said.

The characteristic white nose seen on bats with the fungus on them was not present on surveys from the two Arkansas caves and the fungus was only present in microscopic amounts, officials said.

In April 2010, the state parks department closed Devil?s Den Cave and Ice Box Cave at Devil?s Den State Park, and War Eagle Cave at Withrow Springs State Park, to the public as precautions to protect the caves from the possibility of contamination from white-nose syndrome. Earlier, in May 2009, Farmer?s Cave and Big Ear Cave at Devil?s Den closed as precautionary measures.

While Blanchard Springs Caverns near Mountain View remains open, all other caves on the Ozark National Forest were closed in 2009. Decontamination procedures were set in place at Blanchard Springs Caverns at that time as recommended by the U.S. Fish and Wildlife Service. The procedures include a pre-screening questionnaire for cave visitors, decontamination measures for visitors having visited a cave in a state positive for white-nose syndrome, and limits on items that can be carried into the cave.

?Safeguarding natural resources is an integral part of Arkansas State Parks? mission,? State Parks Director Greg Butts stated in a news release Monday. ?We know the public understands why we?re working with other state and federal agencies to do all we can to protect Arkansas?s caves and the bat species that inhabit them.?

(AP) ? It's judgment day for Army Pfc. Bradley Manning, the soldier charged with aiding the enemy for giving troves of U.S. government secrets to WikiLeaks.

The military judge hearing the court-martial for the former intelligence analyst was expected to announce her decision Tuesday afternoon. Manning faces 21 counts including espionage, computer fraud and theft charges, but the most serious is aiding the enemy, which carries a possible life sentence.

Prosecutors have tried to prove Manning had "a general evil intent" and knew the classified material would be seen by the terrorist group al-Qaida. Legal experts said an aiding-the- enemy conviction could set a precedent because Manning did not directly give the classified material to al-Qaida.

"Most of the aiding-the-enemy charges historically have had to do with POWs who gave information to the Japanese during World War II, or to Chinese communists during Korea, or during the Vietnam War," Duke law school professor and former Air Force judge advocate Scott Silliman said.

Manning's supporters also worry a conviction on the most serious charge will have a chilling effect on other leakers.

The verdict by judge Col. Denise Lind follows about two months of conflicting testimony and evidence. Manning, a 25-year-old native of Crescent, Okla., has admitted to sending more than 470,000 Iraq and Afghanistan battlefield reports, 250,000 State Department diplomatic cables and other material, including several battlefield video clips, to WikiLeaks while in Iraq in early 2010. WikiLeaks published most of the material online.

The video included footage of a 2007 U.S. Apache helicopter attack in Baghdad that killed at least nine men, including a Reuters news photographer and his driver.

Manning said he sent the material to expose war crimes and deceitful diplomacy. In closing arguments last week, defense attorney David Coombs portrayed Manning as a naive whistleblower who never intended for the material to be seen by the enemy. Manning claims he selected material that wouldn't harm troops or national security.

Prosecutors called him an anarchist hacker and traitor who indiscriminately leaked classified information he had sworn to protect. They said al-Qaida leader Osama bin Laden obtained copies of some of the documents WikiLeaks published before he was killed by U.S. Navy Seals in 2011.

A conviction on the most serious charge, if upheld on appeal, "would essentially create a new way of aiding the enemy in a very indirect fashion, even an unintended fashion," said Air Force Reserve Lt. Col. David J.R. Frakt, a visiting professor of law at the University of Pittsburgh.

In bringing the charge against Manning, prosecutors cited the Civil War-era court-martial of Pvt. Henry Vanderwater, a Union soldier convicted in 1863 of aiding the enemy by giving an Alexandria, Va., newspaper a command roster that was then published.

Coombs countered that the Civil War-era cases involved coded messages disguised as advertisements. He said all modern cases involve military members who gave the enemy information directly.

Manning also is charged with eight federal Espionage Act violations, five federal theft counts, and two federal Computer Fraud and Abuse Act violations, each punishable by up to 10 years; and five military counts of violating a lawful general regulation, punishable by up to two years each.

iOS 7 beta alludes to biometric sensor for next iPhone

The most recent version of the iOS 7 beta has leaked, prompting plenty of developers to go digging and see what Apple has in store for the latest iteration of its mobile operating system.

While there are plenty of fixes and tweaks coming, the biggest surprise came in the discovery of a new folder dubbed "BiometricKitUI."

Either undetected or not present in earlier versions of the beta, the new folder includes code strings detailing how the iPhone will be able to recognize a user through a sensor in the home button.

Though the code doesn't offer any clues as to whether this feature will be implemented in the iPhone 5S or the iPhone 6, it certainly appears as if all those patents and leaks may pan out sooner rather than later.

Can you digit?

The files were uncovered by Hamza Sood, whose screengrabs showed in greater detail just how this new biometric scanner would work.

Though there were rumors the fingerprint scanning tech would be used in conjunction with a virtual wallet, the details present in the iOS 7 beta seem to hint at less grand schemes.

According to 9to5Mac's sources, the scanner will be merely used for unlocking the iPhone, and the coding gave no indication there would be more depth to the functionality.

As this is just a beta though, it's still entirely possible Apple will implement payment functions tied to biometrics at some point, however the Cupertino company may be waiting until all the kinks are worked out to introduce such a security-intensive feature.

Tweak leaks

Fortunately, even if you're not upgrading to a new iPhone, iOS 7's latest beta also included a host of improvements to the existing interface.

As 9to5Mac reported, the phone call and answer buttons have been retooled a bit, with clearer instructions on how to answer or avoid an incoming call.

A search bar can now be found in Reminders, AirPlay will have new icons, and the HDR function for the camera is now on the main screen instead of hidden away in options.

Siri, too, joins the update parade with a new Q&A feature, but it's not really clear how it works just based on the screenshots.

There will be a new button to change the resolution for iPhone-only apps on the iPad, and there will be new notifications you can choose for completed uploads as well.

iTunes Radio readying broadcast

The latest iteration of the mobile OS wasn't the only beta pushed out this week by Apple, as developers also got their hands on iTunes 11.1 according to 9to5Mac.

Though we already believed iTunes Radio's launch would be synonymous with iOS 7's, the latest iTunes beta features a fully-integrated version of the streaming service, meaning it shouldn't be long until everyone can enjoy Apple's answer to Spotify and other competitors.

All-in-all, it's sounding quite like iOS 7 could be a major step forward for Apple, and could help the company close the gap on Android even further, or at the least, give it a bit more distance from the rest of the pack.

'Wolverine' cuts loose with $53.1M at box office

(AP) ? "The Wolverine" clawed his way to the top of the weekend box office.

The Fox film starring Hugh Jackman as the clawed mutant superhero debuted in first place with $53.1 million in ticket sales at North American theaters.

Last week's top movie, the Warner Bros. horror "The Conjuring," dropped to second place with $22.2 million, followed by two animated pictures.

Universal's "Despicable Me 2" hung onto third place, adding $16.4 million to its domestic take, which is now at $306.8 million. Fox's animated snail-racing adventure "Turbo" was in fourth with $13.7 million.

Adam Sandler's "Grown Ups 2" claimed the fifth spot, earning $11.6 million over the weekend.

The top 20 movies at U.S. and Canadian theaters Friday through Sunday, followed by distribution studio, gross, number of theater locations, average receipts per location, total gross and number of weeks in release, as compiled Monday by Hollywood.com, are:

(AP) ? Pope Francis wrapped up a historic trip to his home continent Sunday with a Mass on Copacabana beach that drew a reported 3 million people, who cheered the first Latin American pope in a remarkable response to his message that the Catholic Church must shake itself up and get out into the streets to find the faithful.

Nearly the entire 4 kilometer (2.5 mile) crescent of Copacabana's broad beach overflowed with people, some of them taking an early morning dip in the Atlantic and others tossing t-shirts, flags and soccer jerseys into the pontiff's open-sided car as he drove by. Francis worked the crowd, kissing babies, taking a sip of mate tea handed up to him and catching gifts on the fly. Even the normally stern-faced Vatican bodyguards let smiles slip as they jogged alongside his car, caught up in the enthusiasm of the crowd.

Many of the crowd had spent the night on the beach, an all-night slumber party to end World Youth Day that had a festive Latin air, with pilgrims wrapped in flags and sleeping bags to ward off the cold. They danced, prayed and sang ? and stood in long lines in front of the armadas of portable bathrooms along the beachfront.

"We were dying of cold but it was worth it," said Lucrecia Grillera, an 18-year-old from Cordoba, Argentina, where Francis lived for a time before becoming pope. "It was a tiring day, but it was a great experience."

The Vatican said more than 3 million people were on hand for the Mass, based on information from World Youth Day organizers and local authorities.

That was far higher than the 1 million at the last World Youth Day vigil in Madrid in 2011 or the 650,000 at Toronto's 2002 vigil.

Many of those at the vigil had tears in their eyes as they listened to Francis' call for them to not be "part-time Christians" and to build up their church like his namesake, St. Francis of Assisi, was called to do.

"Jesus offers us something bigger than the World Cup!" Francis said, drawing cheers from the crowd in this soccer-mad nation.

After Sunday's Mass, Francis was meeting with the bishops of Latin America and the Caribbean, as well as holding a thank-you audience with some of the 60,000 volunteers who organized the youth festival. He was leaving for Rome Sunday night.

"It was such an excellent week, everybody was in such good spirit, you could just feel a sense of peace," said Denise da Silva, a Rio de Janeiro Catholic who was sitting alone on the beach Sunday morning, a Brazilian flag painted on her face. "I have never seen something here in Rio so marvelous as what we have just lived."

Saturday night's vigil capped a busy day for the pope in which he drove home a message he has emphasized throughout the week in speeches, homilies and off-the-cuff remarks: the need for Catholics, lay and religious, to shake up the status quo, get out of their stuffy sacristies and reach the faithful on the margins of society or risk losing them to rival churches.

In the longest and most important speech of his four-month pontificate, Francis took a direct swipe at the "intellectual" message of the church that so characterized the pontificate of his predecessor, Benedict XVI. Speaking to Brazil's bishops, he said ordinary Catholics simply don't understand such lofty ideas and need to hear the simpler message of love, forgiveness and mercy that is at the core of the Catholic faith.

"At times we lose people because they don't understand what we are saying, because we have forgotten the language of simplicity and import an intellectualism foreign to our people," he said. "Without the grammar of simplicity, the church loses the very conditions which make it possible to fish for God in the deep waters of his mystery."

In a speech outlining the kind of church he wants, Francis asked bishops to reflect on why hundreds of thousands of Catholics have left the church for Protestant and Pentecostal congregations that have grown exponentially in recent decades in Brazil, particularly in its slums or favelas, where their charismatic message and nuts-and-bolts advice is welcome by the poor.

According to census data, the number of Catholics in Brazil dipped from 125 million in 2000 to 123 million in 2010, with the church's share of the total population dropping from 74 percent to 65 percent. During the same time period, the number of evangelical Protestants and Pentecostals skyrocketed from 26 million to 42 million, increasing from 15 percent to 22 percent of the population in 2010.

Francis offered a breathtakingly blunt list of explanations for the "exodus."

"Perhaps the church appeared too weak, perhaps too distant from their needs, perhaps too poor to respond to their concerns, perhaps too cold, perhaps too caught up with itself, perhaps a prisoner of its own rigid formulas," he said. "Perhaps the world seems to have made the church a relic of the past, unfit for new questions. Perhaps the church could speak to people in their infancy but not to those come of age."

Francis asked if the church today can still "warm the hearts" of its faithful with priests who take time to listen to their problems and remain close to them.

"We need a church capable of rediscovering the maternal womb of mercy," he said. "Without mercy, we have little chance nowadays of becoming part of a world of 'wounded' persons in need of understanding, forgiveness and love."

Musician JJ Cale dies; wrote Clapton, Skynyrd hits

If musicians were measured not by the number of records they sold but by the number of peers they influenced, JJ Cale would have been a towering figure in 1970s rock 'n' roll.

His best songs like "After Midnight," ''Cocaine" and "Call Me the Breeze" were towering hits ? for other artists. Eric Clapton took "After Midnight" and "Cocaine" and turned them into the kind of hard-party anthems that defined rock for a long period of time. And Lynyrd Skynyrd took the easy-shuffling "Breeze" and supercharged it with a three-guitar attack that made it a hit.

Cale, the singer-songwriter and producer known as the main architect of the Tulsa Sound, passed away Friday night at Scripps Hospital in La Jolla, Calif. His manager, Mike Kappus, said Cale died of a heart attack. He was 74.

While his best known songs remain in heavy rotation on the radio nearly 40 years later, most folks wouldn't be able to name Cale as their author. That was a role he had no problem with.

"No, it doesn't bother me," Cale said with a laugh in an interview posted on his website. "What's really nice is when you get a check in the mail."

And the checks rolled in for decades. The list of artists who covered his music or cite him as a direct influence reads like a who's who of the Rock and Roll Hall of Fame ? Clapton, Neil Young, Tom Petty, Johnny Cash, Mark Knopfler, The Allman Brothers, Carlos Santana, Captain Beefheart and Bryan Ferry among many others.

Young said in Jimmy McDonough's biography "Shakey" that Cale and Jimi Hendrix were the best guitar players he had ever heard. And in his recent memoir "Waging Heavy Peace," Young said Cale's "Crazy Mama" ? his biggest hit, rising to No. 22 on the Billboard singles chart ? was one of the five songs that most influenced him as a songwriter: "The song is true, simple, and direct, and the delivery is very natural. JJ's guitar playing is a huge influence on me. His touch is unspeakable."

It was Clapton who forged the closest relationship with Cale. They were in sync musically and personally. Clapton also recorded Cale songs "Travelin' Light" and "I'll Make Love To You Anytime" and included the Cale composition "Angel" on his most recent album, "Old Sock." Other songs like "Layla" didn't involve Cale, but clearly owe him a debt. The two also collaborated together on "The Road to Escondido," which won the Grammy Award for best contemporary blues album in 2008.

Clapton once told Vanity Fair that Cale was the living person he most admired, and Cale weighed the impact Clapton had on his life in a 2006 interview with The Associated Press: "I'd probably be selling shoes today if it wasn't for Eric."

That quote was typical of the always humble Cale. But while Clapton was already a star when he began mining Cale's catalog, there's no doubt the music they shared cemented his "Clapton is God" status and defined the second half of his career.

"As hard as I've tried I've never really succeeded in getting a record to sound like him and that's what I want," Clapton said in a "Fast Focus" video interview to promote "Escondido." ''Before I go under the ground, I want to make a JJ Cale album with him at the helm."

Clapton described Cale's music as "a strange hybrid. It's not really blues, it's not really folk or country or rock 'n' roll. It's somewhere in the middle."

Cale arrived at that intersection by birth. Born John Weldon Cale in Oklahoma City, he was raised in Tulsa. Buffeted by country and western on one side and the blues on the other, Oklahoma offered a melting pot of styles. Cale leaned on those styles as he spent his formative years in Los Angeles and Nashville, but he also used drum machines and often acted as his own producer, engineer and session player. He'd bury his own whispery vocals in the mix, causing the listener to lean in and focus.

"I think it goes back to me being a recording mixer and engineer," Cale said in a 2009 biography on his website. "Because of all the technology now you can make music yourself and a lot of people are doing that now. I started out doing that a long time ago and I found when I did that I came up with a unique sound."

I had been harping to nurse's about my elderly fathers condition every day before he was sent to hospital by ambulance[ I WAS IGNORED] .
To make a true and factual statement about 3 of the nursing homes i had my elderly father in ,i noticed one thing in common with all of the three nursing homes . The staff are friendly to family members when they are on the sight of the nursing home. If a family member makes a special effort like being at the nursing home every day 7 days a week for extended periods of time. The staff and the employees become paranoid about your presents, reason they get paranoid is they become lax and complacent in their duties and tend to set around and do nothing when ever they get the chance.

The following statement happened to me at ParkView Care Center located in Paris Texas. I had a female nurse make special effort to confront me for about three days in a row when i walked into to check on my elderly father, this nurse would walk up to me as i entered the ParkView Care Center nursing home and she ask me --(DONT YOU HAVE A JOB YOU NEED TO GO TOO ) this nurse was i assume trying to intimidate me i guess .
I was offended by this statement but said nothing at the time . The red headed female nurse did this the following 2 days as i went to visit my elderly father.
This kinda of behavior leads me to think that they [ OF COURSE I'M SURE THEY WOULDN'T ADMIT TO THIS THOUGH ] ' where trying to get me to stop my regular visits. [ GOD FOR BID I WOULDN'T WON'T TO INTERFERE WITH THE FOLKS CHAIR AND RELAXATION TIME, IF YOU CATCH MY DRIFT. ]
I myself have seen bed alarms at PARK VIEW CARE CENTER NURSING HOME go off beeping for 2 to 3 hours at a time from the elderly residence rooms ,which needed a nurse to check on them .The third shift was the worse! On regular occasion's the residence bed alarms would be ignored by the nurse's at the nurse's station for periods from 1hour up to 3 hours at a time. [ Good God where is the compassion , these people should be ashamed of their selves.] ,One night i was up late with my elderly father watching television in the front of the building .
I heard the night nurse scream at the top of her voice at one of the elderly female residence's. The night nurse jumped up from her chair [ setting down imagine that ] and trotted from behind the nurse's station the whole time screaming at the top of her voice at the elderly woman , as the nurse got close enough to the chair which the elderly woman set in , the nurse grabbed both arms of the elderly residents chair and the nurse placed her face about 2 inches from the elderly resident face screaming as loud as she could at the elderly resident, for spitting on the floor. The poor old lady had Parkinson's .
The elderly woman didn't realize where she was, the elderly lady was handicapped. The night nurse must have lost her mind . [scared the holy hell out of the old lady]. The nurse did not know i was up front with my elderly father watching television late in the evening when this event happened. Once the night nurse noticed me watching what she was doing , she quickly walked back to her chair behind her official nurse's station. The night nurse scared the old lady so bad the elderly woman did not say anything verbally out loud to anyone the whole time that i noticed while i was visiting at this nursing home and i was there 7 days a week 5 to 8 hours a day.

One thing i will not forget is the bed alarms which go off at night from the elderly residents rooms . The nurse's on the night shift set at the nurse's station and ignore the loud beeping alarms and the flashing lights. [good god this is pitiful] this was a regular thing on the late shift for the most part .
The most upsetting thing i happen to witness once was an elderly resident go code blue [ stop breathing ] one night . The young nurse on duty ran from the room to the phone to call the doctor on the phone [she said the doctor would not answer the page] then she gave up on trying to reach the doctor she then called her head nurse at home [this all happened about 9:45pm at night] .
Mean while the elderly resident has gone with out breathing for about 9 or 10 minutes at this point, the head nurse told the young nurse on duty to call 911 and get the EMS guys to try to revive him . She then called 911 the EMS guys took about 6 minutes to arrive . Point of this story is the elderly man coded blue and went about 14 too 15 minutes with out any attempt to revive him ,while i stood watching all this [I thought to myself good god is this the way you do things] 14 too 15 minutes is way too dam long to let an elderly person go before you attempt to revive him.
[ This code blue happened at LEGENDS NURSING HOME in Paris Texas ]. The things which go on in nursing homes is ungodly i could write a small book but i will keep the rest of this to my self for now.

I WOULD LIKE TO SAY THIS TO ANYONE READING THIS, IF YOU HAVE FAMILY THAT YOU TRULY LOVE AND ARE CONCERNED ABOUT ,"DO NOT" FULLY TRUST STRANGERS TO TAKE CARE OF YOUR LOVED ONES . One last note PARK VIEW CARE CENTER IN Paris Texas should be closed down . One more thing if your loved one dies while in the care of the Park view care center be prepared for a complete change in the way the staff at this facility talk with you and treat you if you return to discuss pro rated billing [ which means they try to stiff you with back dated charges] or to visit other residents at this nursing home .
The staff becomes real real paranoid and unfriendly . I even had the janitor walk up to me and with a condescending smile get in my face and he said [ don't make me have to throw you out of here] ""WHAT A DUM ASS THIS GUY WAS"".
I was always polite with all employees at this nursing home in fear that my elderly father might be treated badly in retaliation if i had made someone mad. I will post more about the Paris Texas Nursing homes in my area in coming articles . I WRITE THESE ARTICLES FROM MY EYE WITNESS FOR THE BENEFIT OF THE ELDERLY AND THE HANDICAPPED PEOPLE, WHO NEED ALL THE HELP THEY CAN GET BECAUSE THE ELDERLY FOR THE MOST PART ARE HELPLESS AND NEED THE YOUNGER PEOPLE TO GET THERE ASS IN GEAR AND HELP OUT NOT LOOK FOR A EASY WAY OUT .

On August 5, 2002, the Company was served in a lawsuit filed by the State of Arkansas styled Arkansas v. Diversicare Leasing Corp. d/b/a Eureka Springs Nursing & Rehabilitation Center, et. al., case number 02-6822 in the Circuit Court of Pulaski County, Arkansas. The allegations against the Company include violations of the Arkansas Abuse of Adults Act and violation of the Arkansas Medicaid False Claims Act with respect to a resident of the Eureka Springs facility. This action is scheduled for trial on September 13, 2004. On February 18, 2004, the Company was served in six additional lawsuits filed by the State of Arkansas in the Circuit Court of Pulaski County, Arkansas. The six lawsuits involve fifteen patients at five nursing homes operated by the Company in Arkansas and also allege violations of the Arkansas Abuse of Adults Act and the Arkansas Medicaid False Claims Act. The six complaints, in the aggregate, seek actual damages totaling approximately $250,000 and fines and penalties in excess of $45 million. No trial date has been set in these six actions. However, the Company cannot currently predict with certainty the ultimate impact of the above cases on the Company?s financial condition, cash flows or results of operations. The Company intends to vigorously defend itself against the allegations in all of these lawsuits.
